Abstract : The present study discusses a social issue which often leads to court trials with regard to the benefit rights of women in the waiting period. The relevant concepts are defined and the Fiqh scholars’ approaches are reviewed, until choosing the opinion believed to achieve justice and the objectives of the Sharia.

Abstract : The present study explores some matters in the Divorce Section of the Jordanian Marital Status Law no. 36 of 2010, in which legislative choices were made in disparity with those made by mainstream scholars in the four Fiqh schools. The purpose of the Jordanian legislator is investigated by means of reviewing the Divorce Section. It is found that only three such cases, which actually have a notable perspective
